Terms of Service

The terms and conditions governing your use of TheNxtProject's remote retail monitoring services.

Agreement Overview

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and TheNxtProject ("Company," "we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.

Service Description

TheNxtProject provides a managed remote operations service for retail and mobile store chains. Our services include:

  • Live Camera Monitoring: Our trained staff monitor your existing Google Cameras and CCTV feeds in real-time.
  • Manual Spot Checks: Regular performance evaluations of your floor staff's engagement and sales techniques.
  • Direct Reporting: Daily and weekly performance reports delivered to store owners via WhatsApp, SMS, or email.
  • Instant Alerts: Real-time notifications when critical issues are detected during monitoring.
  • Coaching Insights: Actionable recommendations to improve store performance.

We are not a software-as-a-service (SaaS) company. We provide human-led oversight using your existing infrastructure.

Client Responsibilities

As a client of TheNxtProject, you agree to:

  • Provide secure, authorized access to your existing camera systems for monitoring purposes.
  • Ensure that all camera installations comply with applicable local, state, and federal privacy laws.
  • Maintain working internet connectivity for your camera systems at all times during the service period.
  • Notify us promptly of any changes to your store operations, camera systems, or access credentials.
  • Use our reports and insights solely for legitimate business improvement purposes.
  • Ensure that your employees and customers are informed of camera monitoring as required by law.

Payment Terms

  • Service fees are outlined in your individual service agreement and are billed on a monthly basis.
  • Payment is due within 15 days of invoice date unless otherwise agreed upon.
  • Late payments may incur a service charge of 1.5% per month on the outstanding balance.
  • We reserve the right to suspend services for accounts that are more than 30 days past due.
  • All fees are non-refundable once the monitoring period has commenced, unless otherwise stated in your agreement.

Confidentiality & NDA

We take confidentiality seriously. Both parties agree to:

  • Maintain strict confidentiality of all business information, monitoring data, and performance reports.
  • Not disclose any proprietary information to third parties without prior written consent.
  • Use non-disclosure agreements (NDAs) as standard practice for every client engagement.
  • Ensure that all team members with access to your data are bound by internal confidentiality policies.

Limitation of Liability

To the maximum extent permitted by law:

  • TheNxtProject shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services.
  • Our total liability shall not exceed the total amount of fees paid by you in the 12 months preceding the claim.
  • We are not responsible for losses resulting from camera system failures, internet outages, or circumstances beyond our reasonable control.
  • We do not guarantee specific revenue increases or business outcomes, though we strive for measurable improvement.

Term & Termination

  • The initial service term is specified in your individual service agreement.
  • Either party may terminate the agreement with 30 days' written notice.
  • We may terminate immediately if you breach any material term of this agreement.
  • Upon termination, we will securely delete all monitoring data within 90 days unless legally required to retain it.
  • Any outstanding fees remain due and payable upon termination.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with applicable rules, unless both parties agree to jurisdiction in a court of competent authority.
